Academia Sinica Abstract: Exploring the Notion of “Hybrid Legal Regime” and Taiwan as an Example Jean-Marc Coicaud Rutgers Law School, Rutgers University, USA The paper will focus on the notion of “hybrid legal regime” in the context of comparative law and international law. The paper will explore four main points. First, it will examine what is meant by “hybrid legal regime” and how this notion is related, in terms of similarities and differences, to other approaches, such as the one of legal pluralism but not only. Second, it will offer an overview of how the fields of comparative law and international law could benefit from paying more attention to the notion of “hybrid legal regime”. In particular this would allow highlighting the dynamic dimension of legal regimes and the interactions that tend to take place among them. Third, it will focus on Taiwan as a case study. In this perspective, it will show the relevance and significance of focusing on Taiwan as a case study. Fourth, and finally, the paper will touch upon further perspectives of research for the way forward. |
